واجبات الإنسان أم حقوقه... أيهما يُقَدَّم؟

محاولةٌ فكريةٌ جديدةٌ لسَدِّ ثغرةٍ في مكتبة تنمية الإنسان، خليفةِ الله في الأرض، ورأسمالِ الدُّوَل المدنيّة، ومشاركةٌ في تحقيق استراتيجية الأمم المتحدة للتنمية المستدامة 2030م وطرح رؤية جديدة لعلاج قضيّة حقوق الإنسان من زاوية غير معتادة؛ حيث تدور الدراسة حول أولوية الاهتمام بواجبات الإنسان، فلو قام كل فردٍ أو جماعة أو مؤسسة بالواجبات خير قيام، لتحقّقت الحقوق بشكل تلقائي، لأن المشرّع عندما يُقرّرُ حقًّا فإنه يُنشئ في الوقت نفسه واجبًا مقرّرًا على المكلّف نحو هذا الحق، وبهذا الاستنتاج يتبيّن أن ظهور الواجب مرحلةٌ سابقةٌ على ظهور الحق، وبالتالي فالاهتمام بالواجب مُقَدّم على الحق، فأغلب الواجبات التي يُؤدّيها الإنسان هي نتيجة لحقٍّ مسؤولٍ عنه، ويظهر هذا الحق للعيان كثمرة بعد ممارسة الواجب. بدأت الدراسة في إطارها النظري بعرض تحليل المفاهيم الأساسية، ونماذج براهين أولوية تقديم الواجبات، وفي الإطار العملي استعرض المؤلف أبرز واجبات الإنسان مع أقسام الوجود المختلفة التي يتعامل معها الإنسان.

A new intellectual attempt to fill a gap in the library of the development of human, Allah’s representative on earth and the capital of civil states, and a participation in achieving the United Nations’ 2030 Agenda for Sustainable Development, and presenting a new vision to handle the issue of human rights from an unusual angle. The study focuses on the priority of paying attention to human duties. If every individual, group, or institution performs duties in the best way, such rights would be automatically accomplished since when the legislator legislates a right, He simultaneously creates a duty to be applied to the person in charge of this right. Hence, it becomes clear that the emergence of duty is a stage prior to the emergence of right, and therefore, attention to duty takes precedence over attention to right as most of duties performed result from a right which a person is in charge of. In addition, such right is evidently an outgrowth of performing the duty. In the theoretical framework, the study begins to present the analysis of the basic concepts, and models of proofs of the priority of presenting duties, and in the practical framework, the most prominent duties of human are presented with the various existence sections which a human is dealing with.
