مدخل إلى القانون والعلوم الاجتماعية

تتمثل أهداف هذا الكتاب في تحسين فهم الطلاب والباحثين في العلوم الاجتماعية والقانون لإشكالية العلاقة بين القانون والمجتمع، وتشجيع المزيد من الطلاب والأكاديميين على اعتماد الدراسات الاجتماعية للقانون حقلًا بحثيًّا، وإثبات فائدتها في الأبحاث القانونية. يسعى الكتاب لتشجيع التفكير النقدي والإبداعي في القانون بوصفه نظامًا من الأفكار ومؤسسة اجتماعية في الوقت نفسه. ويهدف أيضًا إلى التشجيع على استكشاف العلاقات المتبادلة بين المناهج والأفكار والممارسات القانونية وتلك الخاصة بالتخصصات الأخرى التي يتفاعل معها القانون باستمرار. لهذه الغاية، يركز الكتاب على مجموعة من المقاربات المهمة المستمدة من النظرية الاجتماعية، بما في ذلك علم الاجتماع، والأنثروبولوجيا، وعلم السياسة، وعلم الاقتصاد. ومن شأن التطبيق الفعال لهذه المقاربات أن يتيح التفكير في القانون في سياقه التاريخي والفلسفي والاقتصادي والسياسي والاجتماعي، مثلما يوفر منطلقًا للتقييم النقدي لقيمة مبادئ وممارسات قانونية معينة وأهميتها، وكذا لتقديم مقترحات أولية للتطوير والإصلاح القانونيين المستقبليين.

This book aims to improve students and researchers in the social sciences and law’s understanding of the relationship between law and society, encourage more students and academics to adopt social studies of law as a research field, and demonstrate its usefulness in legal research. What it seeks is to encourage critical and creative thinking about law as both a system of ideas and a social institution. It also aims to encourage exploration of the interrelationships between legal approaches, ideas and practices and those of other disciplines with which law continually interacts. To this end, the book focuses on a range of important approaches drawn from social theory, including sociology, anthropology, political science, and economics. The effective application of these approaches should enable thinking about law in its historical, philosophical, economic, political and social context, and provides a platform for critically evaluating the value and importance of particular legal principles and practices, as well as for making preliminary proposals for future legal development and reform
