العقود المدنية في القانون المدني القطري (البيع والإيجار) Civil Contracts in Qatari Civil Law (Sale and Lease)

يتناول هذا الكتاب بالشرح أهم عقدين من العقود المسماة التي نظمها المشرع القطري وهما: البيع والإيجار؛ نظرًا لأهميتهما الخاصة على المستوى العملي، فهما - من ناحية - من أكثر العقود اليومية التي يلجأ إليها الناس، ومن جانب آخر فيهما من الأحكام والمبادئ القانونية الأساسية ما يعد مهمًا في التكوين القانوني لطالب القانون؛ نظرًا لامتداد تطبيق هذه القواعد إلى غيرهما من العقود الأخرى. ويتم تناول عقد البيع من خلال قسمين يسبقهما فصل تمهيدي يتناول ماهية البيع وخصائصه. وفي القسم الأول تمت دراسة انعقاد البيع في الباب الأول منه، وخصّص الباب الثاني لدراسة آثار عقد البيع؛ حيث تمت دراسة التزامات البائع والمشتري، وفي الباب الثالث تمت دراسة الأحكام الخاصة ببعض أنواع البيوع. وقد خصص القسم الثاني لدراسة الأحكام العامة لعقد الإيجار، من خلال مبحث تمهيدي للتعريف بالإيجار وخصائصه، وثلاثة أبواب: خصص الباب الأول لانعقاد الإيجار، وأفرد الباب الثاني لدراسة آثار الإيجار، حيث تم بيان التزامات المؤجر والمستأجر والتنازل عن الإيجار، والإيجار من الباطن، أما الباب الثالث فقد خصص لانتهاء الإيجار.

This book deals with the explanation of the two most important contracts of the special contracts organized by the Qatari legislator, which are sale and lease, due to their special practical importance. The are among the most used daily contracts, as well as comprising basic legal provisions and principles that are important in the legal formation of a law student; as the application of these rules extends to other contracts. The sales contract is dealt with through two sections preceded by an introductory chapter dealing with the nature of the sale and its characteristics. In the first chapter of this section, the contract of sale is studied, while the second chapter is devoted to the effects of the sales contract, where the obligations of the seller and the purchaser are focused on, and in the third chapter, the provisions relating to some types of sales are studied. In the second section, the general provisions of the lease contract are studied, through an introductory study of the definition of the lease and its characteristics, and three chapters: the first chapter was devoted to the lease contract, and the second chapter focuses on the effects of the lease, where the obligations of the lessor and the tenant and the assignment of lease, and sub-lease are explained, and the third chapter is designated for the end of the lease.
